Commission Terms of Service and Use

If you're reading this, it means you are thinking about commissioning me! Thank you so much for considering my art for your project. I LOVE making peoples' ideas come to life and I hope we can work together!

Before we make things official, please take a look at these Terms of Service. By commissioning me or paying your invoice, you AUTOMATICALLY AGREE to these Terms of Service. Please also note that these Terms may change at any time without notice, so repeat commissioners may want to give them a quick read before purchasing a commission. You can view the change log at the end of the Terms to see what has changed and when.

Failure to adhere to these Terms of Service will result in my automatic denial of any future commissions from you!

The Terms

  1. Payment for your commission will be completed via PayPal invoice only. (In certain cases I will also accept Cashapp or Venmo, we can discuss this during your quote if that's the payment method you prefer!) Additionally, I do not begin work until the first payment is received.

  2. You are responsible for paying the entire quoted price we discussed when talking about the commission, and in the manner and time frame we discussed (usually either fully up-front or half-and-half). Failure to pay the second half of your price (if applicable) in a timely manner will render the commission null and void, meaning I will be able to use your partially-finished commission in any way I wish, without refund of your initial payment.

  3. Quoted prices at the start of a commission discussion are the final price 99% of the time. However, multiple revisions may incur an extra fee based off of complexity. I will ALWAYS notify you of any extra fee before making any revisions, so don't worry about that!

  4. Commissions are non-refundable. I offer several free revisions to each commission (for more details, see the How it Works page), so you have plenty of time to make sure it's what you really want!

  5. Just as you agree to these terms, I pledge to finish your commission in a timely manner. Updates between phases (sketch, lining, etc) can be requested at any time via the same channel you ordered the commission through (IG message, email, etc).

  6. When posting your commission anywhere online, giving me credit isn't necessary (though it is greatly appreciated!), but DO NOT CLAIM THE ART AS YOUR OWN.

  7. Making personal goods with your commission is allowed (printing it out for your own use, using it as gifts for friends, etc), but selling anything with your commission on it is not allowed unless we have agreed upon the commission being a Merchandise Commission (see Term 13).

  8. Do not alter the artwork you receive in any way (besides resizing or cropping), and do not remove my signature.

  9. I do not allow re-sells or "adopts" of any of my commissions. Once you purchase a commission, you are not allowed to "flip" or re-sell the design. The commission is yours and yours alone. (Of course, giving a commission as a gift for someone else's use is allowed, but they will be expected to follow these terms as well!)

  10. On the topic of art transference, NONE OF MY ARTWORK MAY BE USED TO PROMOTE ANY SORT OF CRYPTOCURRENCY OR NFTS. I do not support NFTs and my artwork may not be used as an NFT, nor may it be displayed on any website that is associated in any way with the purchase, sale, or support of NFTs. If this rule is broken, I will not hesitate to take legal action against you or your organization.

  11. My artwork may not be used to train any machine learning or other AI models. I do not give you permission to upload your commission to any machine learning database or program.

  12. I reserve the right to post your commission to my social media or online portfolio (with credit to you in the form of a watermark). (Note: this is the one term that is 100% flexible; I have no problem if you'd prefer I do not post your commission on my socials!)

  13. Merchandise Commissions will have 25% of the commission total added to their final price. A Merchandise Commission is anything that appears on a product you will be selling - whether it's T-shirts, stickers, etc. Logo commissions, packaging designs, book covers, and some other non-character commissions do not incur this 25% fee - it is built into the quoted price. Once your commission is finished, feel free to go wild and make as many products as you like with it! The 25% fee is one-time - for example, if you commission a design for a mug, the final price will have 25% added. You can then also make stickers, notebooks, etc with the same design without paying another 25%. You can also pay this fee retroactively - for example, if you commission me in October for a monster portrait, then in December, you decide you'd like to sell t-shirts of this design, you can pay 25% of your original commission price at that time.

  14. Texas residents will be subject to a small amount of sales tax (~7%) on top of their commission amount due to local laws and compliance.

  15. Keep in mind that all my Patrons at the pop pals ($5) or above tiers get a 15% discount on all commission types!
